Our website grants you non-exclusive limited license to use the web templates and other products sold through our website (https://envato.com) by Aivah in accordance with these Terms & Conditions (the “license”) issued by our company.
1. Theme Licensing & Usage
All of our themes are licensed under the same GNU general public license as WordPress and few are Envato Licensed. Our themes may be used by our customers on as many websites as they like based on the type of license they purchase.
2. Photoshop Files License
The Photoshop PSD design files for our themes come packaged separately from the actual theme files and are not GPL-licensed. They are licensed and copyrighted under Aivahthemes.com. You are not allowed to redistribute or resell these files in any way.
3. Updates
These updates are available to buyers who have made a theme purchase. All templates are always designed to be compatible with the latest available version of WordPress, but we can give no guarantee, that older templates will run with future versions of WordPress. We are however committed to doing our best to make all the themes compatible with future releases of WordPress.
3. Ownership
You may not claim intellectual or exclusive ownership of any of our products, modified or unmodified. All products are the property of Aivah and AivahThemes. Our products are provided “as is” without warranty of any kind, either expressed or implied. In no event shall our juridical person be liable for any damages including, but not limited to, direct, indirect, special, incidental, or consequential damages or other losses arising out of the use of or inability to use our products.
5. Site Content
All content, including imagery, published on the Aivahthemes.com domain, including site content published on the showcase, is property of Aivahthemes and under copyright. Any replicated site content must be authorized and referenced back to the source. Content from the Aivahthemes website shall not be used or exploited for any commercial and non-private purposes without the prior written consent of Aivahthemes.
6. Support
We only offer support for our themes, features, and functionality unique to our theme (beyond that of WordPress). Please note that we cannot assist with general WordPress support or help with theme modifications and customizations in any capacity within our complimentary support.
Support Not Included:
• Third-party plugins
• WordPress support (Use wordpress.org forums)
• Addition of new features
• Extending default theme features
• Theme modifications and customizations
While we do support our themes, we offer no support via email or otherwise for installation, customization, or administration of WordPress itself.
Support Times: Our support hours are Monday – Friday, 10:00 am – 5:00 pm (IST+5.30). Upon posting to the support forum, we make it our goal to respond within 24-48 hours. (Often we will monitor the forums during non-hours and weekends, but this is not the standard.)
7. Bugs
We will address all theme bugs as quickly as possible once they are brought to our attention. Once we have corrected, tested, and updated our theme files, we notify you of an available update ready for download via our support forum using a ‘sticky’. You can then head on over to ThemeForest to re-download the new version of the theme files.
8. Customization
When time is available we are free to help with contracted theme modifications and customizations. Our standard hourly rate is (USD) $55 per/hour. Once you’ve determined the details of what you need to be done, you may contact us via the forum for a private quote.
9. Warranty
Aivahthemes does not warranty or guarantee these templates in any manner. We cannot guarantee they will function with all 3rd party components, plugins, or web browsers. Browser compatibility should be tested against the demonstration templates on the demo server. Please ensure that the browsers you use will work with the templates as we cannot guarantee that Aivahthemes templates will work with all browser combinations.
10. Changes
Aivah & Aivahthemes reserves the right, at its sole discretion, to modify or replace any part of this Agreement. It is your responsibility to check this Agreement periodically for changes. Your continued use of or access to the Website following the posting of any changes to this Agreement constitutes acceptance of those changes. Aivahthemes may also, in the future, offer new services and/or features through the Website (including, the release of new tools and resources). Such new features and/or services shall be subject to the terms and conditions of this Agreement.
